What Is Probate In Maryland?

Probate is the process by which a person’s estate is administered following their death. If there is a will, it is submitted to the court for validation and the instructions for dividing up the assets to the intended beneficiaries enacted. In absence of a will, the estate is divided based on a state-specified formula.

The probate process in Maryland begins when the court is informed of the passing of the person who has either created or not created a will (the decedent). If there is a will, it must be submitted to the court. From there, the probate process will look different for different people, as not all estates are the same. However, they will generally follow this pattern:

  • File a petition to probate the estate, which includes whether it is a small or large estate
  • File a list of Interested Persons, which primarily includes the beneficiaries of the estate
  • File an Inventory and Information report, essentially inventorying the assets
  • File a First Account, which is a report of the activity of the estate’s assets
  • Creditors and Interested Persons can file a claim against the estate
  • File Subsequent Accounts for any ongoing activity involving the estate
  • File Final Account, distribute the estate, and close probate

When you break it down into steps, the probate process doesn’t seem so intimidating, but in reality, the administrative and logistical burdens alone can be all-consuming, and because it is so highly regulated and detailed, mistakes are not simply overlooked – rather you may find yourself filing the same document for the fourth time, wanting to pull your hair out. Add to that the emotional turmoil of having to make endless decisions about your loved one’s property and assets while in the midst of a fog of grief, and probate begins to feel nearly unconquerable and unending

In order to avoid any missteps and take into account potential anomalies within the probate process, our Rockville probate lawyers will work with you every step of the way to make sure that the estate of your loved one is managed faithfully, while relieving you of the burden of doing it all yourself.
