No-Fault Divorce In Maryland

In 2023, Maryland passed new laws to do away with “at fault” divorce, so you do not need to cite fault within your marriage in order to file for and be granted a divorce. Now, you can divorce based on one of the following reasons:

  • Irreconcilable differences: If you and your spouse cannot come to terms on key differences within your marriage, you can divorce based on an inability to mutually resolve these issues.
  • 6-month separation: You can divorce based on the fact that you and your spouse have been separated for six months or more. One important note here is that you can be considered separated even if you and your spouse still live together.
  • Mutual consent: If you and your spouse decide between the two of you to end your marriage and can agree on all divorce-related issues, in writing, you can be granted a divorce based on mutual consent.

While fault-based grounds no longer affect your ability to get a divorce, things like adultery, abuse, or abandonment may still come into play in your case. Depending on the circumstances,  your spouse’s wrongdoing might entitle you to things such as a larger share of assets, more parenting time or in extreme cases, sole custody..
