What You Need To Know About Divorce In Maryland

In 2023, Maryland updated its divorce laws to reflect that it is now a no-fault divorce state, meaning that you do not need to establish wrongdoing for the breakdown of your marriage in order to be granted a divorce. However, you must cite one of the three following reasons to explain why you are seeking to end your marriage. 

  • Irreconcilable differences: If you and your spouse can’t resolve differences within your marriage and find yourselves at odds with no means for improvement, you can cite irreconcilable differences. 
  • 6-month separation: If you and your spouse have been separated for six months or more, you can file for divorce on the basis of this separation. It’s important to note that you can be considered legally separated even if the two of you still live together.
  • Mutual consent: If you can submit in writing that you and your spouse agree to end your marriage and see eye-to-eye on all issues, including division of assets, alimony, and if you have children, child support and child custody, you can seek a divorce on these grounds.

It’s also important to keep in mind that, although you don’t have to cite fault to be granted a divorce, faults such as adultery or abuse can still come into play during your divorce proceedings. These types of wrongdoing might entitle you to a greater portion of the assets, sole child custody, or another divorce settlement that is advantageous to you.
