Understanding Divorce In Maryland

Maryland is a no-fault divorce state, meaning that you do not have the burden of proving wrongdoing within your marriage in order to seek divorce. However, when you petition for divorce, you will need to cite one of three legally valid reasons. These three reasons are as follows:

  • Irreconcilable differences: If there are differences or disagreements within your marriage that you and your spouse simply cannot work through, you can cite “irreconcilable differences” for the dissolution of your marriage.
  • 6-month separation: If you and your spouse have been separated for six months or more, you can cite this reason for your divorce. Note that separation does not necessarily mean the two of you have been living in separate households - it just means you are pursuing separate lives.
  • Mutual consent: By submitting in writing that you and your spouse are in alignment on your decision to divorce and mutually agree on all issues, including asset division, alimony, child support, and child custody, you can divorce on the basis of mutual consent.

Keep in mind that, although Maryland is a no-fault divorce state, factors such as adultery, substance use, or abuse may still affect the outcome of your settlement or court decision. For instance, if your spouse spent significant marital assets on an affair partner, you may be awarded more alimony; and if there are significant concerns of abuse, or struggles with addiction, the court will consider these factors in determining child custody.
